1. Agreement to terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and THE KINFOLK STUDIO ("we", "us", or "our") regarding your access to and use of our website and services. By accessing or using our site, you agree to be bound by these Terms and all applicable laws. If you do not agree, please do not use the site.
2. Services
THE KINFOLK STUDIO provides influencer marketing services, including but not limited to creator recruitment, outreach, campaign management, content collaboration, and performance reporting. Specific deliverables, fees, and subscription terms are set out in a separate service agreement or order form.
3. Intellectual property
All content on this website, including text, graphics, logos, images, videos, and software, is the property of THE KINFOLK STUDIO or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any content without our prior written consent, except as necessary for your ordinary use of the site.
4. Accounts and conduct
If you create an account or submit information through our site, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree not to use the site for any unlawful purpose, to transmit malware or harmful code, or to interfere with the operation or security of the site.
5. Fees and payment
Subscription and service fees are described in the applicable service agreement, order form, or pricing page. Payments are due according to the schedule set out therein. Failure to pay may result in suspension or termination of services.
6. Limitation of liability
To the fullest extent permitted by law, THE KINFOLK STUDIO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising out of or related to your use of the site or services. Our total liability for any claim shall not exceed the amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD $100), whichever is greater.
7. Indemnification
You agree to indemnify, defend, and hold harmless THE KINFOLK STUDIO and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the site or services, your violation of these Terms, or your infringement of any third-party right.
8. Governing law
These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Any legal action must be brought exclusively in the state or federal courts located in Sheridan County, Wyoming.
